I often hear the comment in the media that a person charged with a criminal offense “got off on a technicality”. I find that offensive.

No one in Canada “gets off on a technicality”.  Our Charter of Rights and Freedoms guarantees all Canadians the right to life, liberty and security of the person; the right to remain silent; the right to be free from unreasonable search and seizure; and, the right to retain and instruct counsel of choice.

To suggest that an acquittal based on a breach of one of these rights is “getting off on a technicality” should be viewed as insulting by every informed member of the public.

My team and I will ensure your Charter guaranteed rights are protected as we help you navigate the often difficult and confusing criminal justice system.
