  • Sexual Offences / Sexual Assault may be prosecuted in one of two ways: by summary conviction or by indictment.

    Sexual assault charges are complex and very stressful and emotional for all parties. Sexual assaults are generally prosecuted by way of Indictment and usually result in sentences which include significant incarceration and registration on both the Provincial and National Sex Offender Registries.   • Sexual Assault is any form of sexual activity with another person without their consent. It includes touching, grabbing, kissing, and attempted or completed oral, anal, or vaginal intercourse without consent.

    Canadian criminal law has very specific and detailed laws relating to the age of consent and the capacity of a person to consent to sexual contact due to, but not limited to: the age of the victim; the use of drugs or alcohol by the victim, or, accused; and, the positive steps that must be taken to ensure consent is freely given before sexual activity commences.

  • The Criminal Code of Canada States for Sexual Acts with a Minor: 151 Sexual interference

    151. Every person who, for a sexual purpose, touches, directly or indirectly, with a part of the body or with an object, any part of the body of a person under the age of fourteen years is guilty of an indictable offence and liable to imprisonment for a term not exceeding ten years or is guilty of an offence punishable on summary conviction. R.S., 1985, c. C-46, s. 151; R.S., 1985, c. 19 (3rd Supp.), s. 1.
